Tom's of Maine $2.9 Million Toothpaste Settlement: How to File Your Claim

If you've bought Tom's of Maine toothpaste in the last five-plus years, you may be owed money.
Colgate-Palmolive and its subsidiary Tom's of Maine have agreed to a $2.9 million settlement to resolve multiple class action lawsuits alleging deceptive and misleading business practices related to the manufacturing, marketing, and sale of certain Tom's toothpaste products.
The lawsuits stem from a May 2024 FDA inspection of Tom's manufacturing facility in Sanford, Maine. During that inspection, the FDA raised concerns that certain conditions at the facility were not in compliance with its Current Good Manufacturing Practices. Following the inspection, a review of pre-release testing data for roughly 4,900 finished toothpastes manufactured over a three-year period found that no batch posed a safety risk to consumers. Tom's and Colgate-Palmolive deny any wrongdoing but agreed to settle to avoid the costs and risks of continued litigation.
Six separate lawsuits were filed across the country and have been consolidated for settlement purposes in the U.S. District Court for the Eastern District of New York.

Who's eligible?
You may qualify if you purchased one or more Tom's of Maine toothpaste products in the United States between November 21, 2020 and March 6, 2026 for personal use — not for resale or distribution. Any flavor, formula, or size of Tom's toothpaste counts.
What could you get?
Without proof of purchase, you can file a claim for the average manufacturer's suggested retail price of one Tom's toothpaste product per household. A standard full-size tube currently retails for about $5.99 on Tom's website. With proof of purchase — receipts, online order history, or credit card statements — you can claim a full refund for up to three products per household. If total claims exceed the available settlement funds, payouts may be reduced proportionally.
How to file
You have until July 6, 2026 to file your claim. Only one claim form can be submitted per household. A final approval hearing is scheduled for September 10, 2026. If the court approves the settlement, payments will be issued roughly 60 days after final approval.
