Domino's Hit With Class Action Over Fees on California Pizza Orders

Domino's is being sued in California federal court over a line item on its receipts that customers say isn't actually a tax.
The class action, filed by plaintiff John Murphy, alleges that Domino's tacks a mandatory fee onto in-store pizza orders and lists it as "Tax 2" on the receipt. According to the complaint, that fee isn't a government tax at all — it's an extra charge Domino's uses to offset its own business costs, passed along to customers without being included in the advertised menu price.
The lawsuit names Domino's Pizza Franchising LLC, Domino's Pizza LLC, and two California franchise operators, Ari Foods Inc. and Aai Foods Inc. It was filed February 26, 2026, in the U.S. District Court for the Northern District of California.
What the lawsuit alleges
Check if you qualify for this settlement
Murphy's complaint argues Domino's violated California's Honest Pricing Act, a state law that requires businesses to include all mandatory fees in the price they advertise. The suit also claims violations of California's Consumers Legal Remedies Act, Unfair Competition Law, and False Advertising Law, along with unjust enrichment.
The complaint alleges the "Tax 2" charge isn't a government tax at all — it's Domino's passing its own operating costs onto customers while giving them the impression they're paying something the state requires.
Who could be eligible
The proposed class covers California consumers who were charged a fee when making an in-person purchase at a Domino's restaurant in the state. The plaintiff is seeking monetary, statutory, and punitive damages, plus a jury trial.
How to file your claim
There is no settlement yet. This case was just filed and is in its early stages, so there's no claim form, no deadline, and no payout amount set. If the case settles or wins at trial, eligible California customers could be owed money back for fees they were charged.
