23andMe $50 Million Settlement Deadline Approaching: How to File Your Claim

23andMe $50 Million Settlement Deadline Approaching: How to File Your Claim

23andMe has agreed to a $50 million settlement over a 2023 data breach that exposed the personal and genetic information of approximately 6.4 million U.S. customers.

If you were a 23andMe customer and received a breach notification, you may be eligible for a payout. The deadline to file is February 17, 2026.

What Happened

In October 2023, 23andMe disclosed that hackers had accessed customer accounts through a credential stuffing attack — using stolen login credentials from other breached websites to break into 23andMe accounts. The compromised data included names, dates of birth, ancestry details, genetic information, and in some cases health reports. The stolen data was reportedly put up for sale on the dark web.

The class action lawsuit alleged that 23andMe failed to adequately protect its users' data. The company filed for bankruptcy in March 2025 and was later purchased for $305 million by a nonprofit led by former CEO Anne Wojcicki. 23andMe has since rebranded to "Chrome."

23andMe denies wrongdoing but agreed to settle to avoid further litigation. The settlement received final court approval on January 20, 2026.

Who's Eligible

You may be eligible if you were a 23andMe customer between May 1, 2023 and October 1, 2023, resided in the United States during that time, and received notice from 23andMe that your personal information was compromised. Eligible customers should have received an email from Kroll Settlement Administration, the court-appointed administrator handling the case.

What You Can Claim

Up to $10,000 if you have documented out-of-pocket losses tied to the breach — things like identity theft, bank fraud, credit monitoring costs, or mental health treatment. You'll need to submit proof. The total cap for these claims is $8.3 million.

Up to $165 if 23andMe notified you that your health information was compromised, including raw genetic data, health reports, or self-reported health conditions.

An estimated $100 statutory cash payment if you lived in California, Alaska, Illinois, or Oregon during the breach period.

All eligible class members also get five years of free privacy and genetic monitoring through CyEx, including identity theft monitoring, dark web monitoring, and genetic anomaly detection — even if you don't file for a cash payment.
